Billing structure. Unless otherwise stated on his pricing page, Scott Gilmour charges $35 per hour for Web Design/Development, Web Marketing, Search Engine Optimization, and other professional services related to Web Marketing. Estimates on projects are based on initial project specifications, and changes requested beyond the scope of the initial parameters of the project will be billed at the hourly rates set previously in this paragraph. A deposit may be required at Scott Gilmour's sole discretion to begin work on new projects (usually between 30% and 50%).
Late payment. Clients have a 30 day grace period to submit payment after the invoicing date. Late payments made after the grace period may be subject to a $29 late fee at Scott's sole discretion.
Interim charge caps. Scott Gilmour has set a $500 interim charge cap. When a client's total bill exceeds $500, that client will need to make an interim payment to bring the total balance lower or face work suspension.
Scott Gilmour reserves the right to waive this cap at his sole discretion.
Scheduling. Scott Gilmour is available to service his clients via phone at 1.541.941.5153, Monday - Friday between 9 am and 5 pm (PST) & Sat. 11 am to 4 pm. Scott may not be available on Sundays and will not be available on Holidays.
No spec work. Scott Gilmour does not accept work on spec.
Browser compatibility. Scott Gilmour represents and warrants that the web site he designs for you will format and function correctly in:
Microsoft Internet Explorer versions 7 and up
Apple Safari version 1.0 and up
Mozilla Firefox version 2.0 and up
Scott Gilmour will make your website compatible for any other browser, including mobile browsers, for the rate of $35 per hour in addition to the initial estimate.
Forward compatibility (IMPORTANT!!). Scott Gilmour cannot be held responsible for the changes made to new versions of Web browsers by the authors/vendors of those Web browsers. Thus, Scott Gilmour does not warrant that his websites will function properly on future versions of Web browsers. If an update to a major browser causes Scott's website to "break," his current hourly rate may be charged to fix it at Scott's sole discretion.
Shared Hosting Services. Scott Gilmour's Basic Shared 15 Plan, Gold Shared 10 Plan, and Platinum Shared 6 plan are all subject to the following terms and conditions:
No Set Bandwidth/Storage Limits: Although Scott does not set any limits on his shared hosting plans, Scott does expect that each client will treat this service with reasonable expectations and not abuse their hosting account. If you intend storage-intensive uses of your account, or require server-intensive hosting for dynamic content (e.g. CMS systems or e Commerce websites) you will be expected to communicate your needs with Scott and follow his recommendations.
FTP Access: FTP access is available upon request, however Scott reserves the right to terminate your services at anytime if he feels you are abusing or over-utilizing your hosting account. Please communicate your needs with Scott to avoid service termination.
Transparency & Exclusivity: Scott Gilmour expects that the client will communicate all server and hosting requirements during all phases of the development process. This service IS NOT intended for websites that were not designed or developed by Scott Gilmour. This service is EXCLUSIVE to clients of Scott Gilmour and is thus a PRIVLEDGE that may be terminated if you abuse your plan in any way.
Requirements: Scott's shared hosting services require that you follow Scott Gilmour's hosting recommendations based on your needs.
BASIC SHARED 15 PLAN REQUIREMENTS: Scott Gilmour's Basic Shared 15 Plan is intended for use with smaller, static websites such as brochure-style websites, marketing websites, and informational websites. This service/plan is not intended for server-intensive websites with dynamic content, some content management systems (CMS), or some E Commerce websites. Consult with Scott Gilmour if you're not sure which plan is right for you.
GOLD SHARED 10 PLAN REQUIREMENTS: Scott Gilmour's Gold Shared 10 Plan is intended for use with medium-sized websites such as smaller content management system (CMS) websites, smaller E Commerce websites, blogs, and other websites which receive a reasonable amount of traffic. Consult with Scott Gilmour to determine which plan is right for you.
PLATINUM SHARED 6 PLAN REQUIREMENTS: Scott Gilmour's Platinum Shared 6 Plan is intended for use with larger websites, dynamic websites, content management system (CMS) websites and blogs that receive high traffic or require more server resources. Consult with Scott Gilmour to determine which plan is right for you.
Termination of Service: Scott reserves the right to terminate your shared hosting service at anytime at his sole discretion. Scott's main priority is maintaining the integrity of his servers for the good of all of his clients. Scott will terminate your service if he feels that you are threatening the integrity of his servers in any way. Scott may or may not give you a 24 hour notice of service termination as a courtesy.
In the event of shared hosting service termination, Scott will provide a pro-rated refund determined by the days left on the plan.
Early Cancellation of Service You may cancel your shared hosting plan before the expiration date for any reason. In the case of early cancellation, Scott will issue a pro-rated refund determined by remaining days for monthly and annual plans.
Assignment of Web project. Scott Gilmour reserves the right to assign subcontractors to any project or portion of a project to insure that the project goals are met as well as on-time completion.
Copyrights and Trademarks. The Client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Scott Gilmour for inclusion in any Web Design or Web Marketing Project are owned by the Client, or that the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, indemnify and defend Scott Gilmour and his subcontractors from any liability (including attorney's fees and court costs), including any claim or suit, threatened or actual, arising from the use of such elements furnished by the Client.
Termination of services by client. A minimum rate of $500 will be charged in the case that completed work is refused by a client and a client does not wish to continue with a project.
Any work refused by a client cannot be used in whole or in part.
Ownership rights. Once a project has been completed, and only once the project has been paid for in full, the client will retain the right to use Scott Gilmour's work for the intended purpose. Use of the work for purposes other than the intended purpose (e.g. Web design graphics used for a print ad) will require Scott's permission.
Scott Gilmour always retains the right to utilize any and all works in his professional repertoire or portfolio for future promotion.
Unforeseen or sudden termination of a project. In the unlikely case that a mishap, illness or accident occurs that makes it impossible for Scott Gilmour to continue a project in progress, the client will be able to retain all work completed up to that date to be used with another freelancer or design firm after any remaining balance has been paid in full.
Other details. More specific details for projects will be included in the contract for that project, and will be enforced in addition to these terms and conditions.
